FASCIST SB 1070: Russ Pearce's Laments.

"Illegal Employers": That's a new phrase to me. Wonder if the SBA has heard it and how they like it. 

Anyway, not to worry any more about this horrible legislation, folks – Pearce is already on top of our concerns – we just need to trust him to be acting in “our” “best interests” since he’s clearly a proven American patriot. After all, look at all his years of public service and the legislation he’s already passed. He makes such a good argument that he should be more respected, that I bolded it in red letters below for you.

It will take us at least a generation to undo the damage that his good work has done to Arizona families and communities…and some can never be healed.


Please tell your legislators to shoot this bill down.

Some concerns have been raised with portions of the legislation I have introduced, SB 1070 safe neighborhoods; immigration; law enforcement (that will known as:  Support Our Law Enforcement and Safe Neighborhood Act).  

I would like you all to know that I have made a good faith attempt to address any legitimate issues in a manner that I feel will not weaken the legislation while hopefully still addressing  your concerns. 

As you know we have to examine each issue as it relates to real world implications and from a perspective that will provide judicial clarification if any challenges are brought against this legislation. 

I would like to take this opportunity to clarify exactly what issues have been raised and how they will be addressed in the Floor Amendment sponsored by Representative Biggs on behalf of myself.  

Provisions of the Biggs Floor amendment:

What about states that issue licenses without confirming legal presence?

v     The Biggs amendment clarifies that federal, state or local government-issued ID only provides a presumption of innocence if the entity requires proof of legal presence.

Does local law enforcement have jurisdiction to transport an illegal alien across state lines?

v     The amendment requiring judicial authorization before transporting an illegal alien out of the state, to ensure that law enforcement is complying with federal requirements.  

Are there any provisions that may “open the door” for implementation of REAL ID?

v     The amendment statutorily prohibits the implementation, authorization, or establishment of REAL ID alleviating any concerns raised by the language.

Will this law create a scenario where cities and counties are continuously battling frivolous lawsuits, including lawsuits from people all across the country?

v     The Biggs amendment stipulates that only legal Arizona residents may brings actions against sanctuary cities and requires and loser pays all reasonable cost and attorney fees. 

NO ONE fights any harder for freedom, limited government and public safety than I do.  Our laws must be enforced, our borders must be secured and citizens have a Constitutional right to this protection under our laws and our Constitution.  I will continue to defend States Rights and our Constitutional liberties.  We must support our law enforcement officers in the protection of Life, Liberty and Property, that includes the rule of law.  

I have two legal opinions which are attached.  However, in spite of this, some folks continue to promote concerns that are not in the bill and are already prohibited by law and the Biggs amendment will even make clear and prohibit Arizona from participating in any form of national ID. 

I have spent several hours working with Governor's Office, F.A.I.R. to address these concerns and others.  I have put words in which will be in the amendment Tuesday, April 13th, prohibiting a form of National ID or radio chip of any kind as indicated in the Obama plan for new ID. 

I also will strengthen the civil rights provision that is already in the bill to prohibit any racial profiling.  I have also strengthened other areas of concern.  I also added language to make sure the verification of information is about aliens and the transportation part is for those in furtherance of an alien remaining in the U.S. such as sanctuary movements or smuggling and NOT a little ole lady taking someone to church or a good Samaritan or any emergency medical needs.  In 25 years there has never been a prosecution of anyone for simply taking someone to church, a church outing, boy scout outing, etc.  I am disappointed some continue to ignore the simple and plain language in the bill.  

SB1070 is the most comprehensive enforcement bill in the nation, it will remove all "illegal" sanctuary policies that exist in many of our cities, and it will allow law enforcement to enforce our immigration laws as intended.

I guarantee this will save lives, American jobs, reduce the cost of government, improve neighborhood safety, improve congestion, move toward smaller classrooms, shorter lines in emergency rooms, reduce rapes and molestations and reduce the number of deaths and maimings of our citizens and more.

Please note that Phoenix has had a more than 50% reduction in homicides this year over last year, after we passed employer sanctions and other illegal alien legislation, and our illegal alien population has decreased by twice the national average in the past two years saving lives and hundreds of millions of dollars in services.

SB1070 will add a "trespass" provision to law enforcement giving them the ability to hold an illegal alien under state law if need be or to just a phone call to ICE and turn them over to ICE.  This provision will allow our law enforcement folks to complete investigations on a suspect and not allow them to be deported before the investigation can be completed.  It also goes after illegal employers and illegal aliens soliciting work and provides for law enforcement to more easily enforce public safety issues on busy streets.

AS I have promised: SB1070 will be amend to clarify issues of concern, but will not be weakened so it jeopardizes our ability to enforce our laws appropriately and withstand future court challenges by the normal suspects.

I must admit, I am disappointed in some folks who have expressed unwarranted concerns in my opinion.  I have worked for over 30 years to protect states sovereignty and in defense of our Republic as intended by our Founding Fathers.  You would think after years and years of caring the torch of freedom, states rights, limited government, in defense of Constitutional government in defense of Life, Liberty and Property some would have a little more trust. 

To be sure, I have asked for additional legal opinions and have been assured by several competent independent Constitutional attorneys, legislative council attorneys and the Maricopa County Attorney's Office that my interpretation is correct.  However, I want to be very clear and will add language to eliminate those concerns as best as I can.

We have already passed legislation to prohibit the State of Arizona from participation in any kind of National ID or Real ID Act and it is current law.  This bill did not and does not change that.  Having said that, I will put language in the bill that enhances the clarity on these issues of concern and make it very clear that nothing in this bill will allow Arizona to be a part of any national ID program. 

There will be similar language to deal with concerns over improper or prolonged detention.  I have had Legislative Council and the Maricopa County Attorney's Office examine this legislation and both have assured me it does allow for any kind of National ID or expand ID requirements in any way.  I have also attached the letter from the MCAO that answered my questions.  I am also pasting the legal opinion from the Arizona Legislative Council at the bottom of this email.

I will make some changes (in the Biggs amendment) to protect the first responders and those good Samaritans transporting illegal aliens (little old ladies taking someone to church) are not in jeopardy in any way.  They are not now under this bill, because they must be committing an additional criminal offense to the state law to be so charged, but I will make it even clearer in the new language.

We should be able to have this bill heard the first of next week on the House floor for COW and 3rd Read.

I will keep you appraised on our progress.

Here's the latest Pearce Alert on his racist, fascist legislation, SB 1070...Be there or otherwise lift your voice by Tuesday, April 13 to register your resistance to this repulsive effort to trump local sovereignty and communities trying to prioritize their law enforcement resources without Pearce's interference...this thing has implications for all of us - citizens, too.

Pearce et al are not representing a LOT of us in Arizona these days...we are not all fascists and racists.

SB1070 Will be heard in the Arizona House of Representatives Tuesday afternoon, April 13th.

This is the best and most comprehensive immigration enforcement bill in the nation.  I would appreciate it if you would send this to your list. This is an important bill. I need calls and e-mails. I have a firm commitment from the Speaker to have the bill 3rd read next Tuesday.  I need to make sure our Republicans stay firm for the rule of law.    Illegal is not a race, it is a crime.   Next Tuesday, I also will be holding a Press Conference at noon and an all afternoon hearing on border violence along with Ranchers and Farmers from the border and the cost of our open border to citizens.

Purpose: Requires officials and agencies of the state and political subdivisions to fully comply with and assist in the enforcement of federal immigration laws.  Establishes crimes involving trespassing by illegal aliens, stopping to hire or soliciting work under specified circumstances, and transporting, harboring or concealing unlawful aliens, and their respective penalties.

Enforcement of Immigration Law

·          Prohibits officials and agencies of this state or counties, municipalities and political subdivisions from restricting or limiting the enforcement of the federal immigration laws to less than the full extent permitted by federal law.

·          Requires officials and agencies to reasonably attempt to determine the immigration status of a person involved in a legitimate contact where reasonable suspicion exists regarding the immigration status of the person.

·          Stipulates that if the person is arrested, the person’s immigration status must be determined before the person is released and must be verified with the federal government.

·          Stipulates that a law enforcement official or agency cannot solely consider race, color or national origin when implementing these provisions, except as permitted by the U.S. or Arizona Constitution.

·          Specifies that a person is presumed to be lawfully present if the person provides any of the following:

Ø        A valid Arizona driver license.

Ø        A valid Arizona non-operating identification license.

Ø        A tribal enrollment card or other form of tribal identification.

Ø        A valid federal, state or local government issued identification.

·          Requires that if a person is convicted of any state or local law, on discharge from imprisonment or any fine imposed, the person must be transferred to ICE or U.S. Customs and Border Protection (CBP). 

·          Authorizes a law enforcement agency to securely transport an unlawfully present alien to a federal facility.

·          Prohibits, except as provided in federal law, officials and agencies of counties, cities, towns or other political subdivisions from being prevented or restricted from sending, receiving or maintaining information relating to the immigration status, of any individual or exchanging that information with another governmental entity for the following official purposes:

Ø        Determination of eligibility for any public benefit, service or license. 

Ø        Verification of any claim of legal domicile if legal domicile is required by law or judicial order.

Ø        If the person is an alien, determination of the person’s compliance with federal registration laws.

Ø        Pursuant to federal laws regarding communication between government agencies and federal immigration agencies.

·          Allows a person to bring an action in superior court to challenge officials and agencies of the state, counties, cities, towns or other political subdivisions that adopt or implement a policy that limits or restricts the enforcement of federal immigration laws to less than the full extent permitted by federal law.

·          Allows the court to order any of the following, if there is a judicial finding of a violation:

Ø        That the person who brought the action recover court costs and attorney fees.

Ø        That the entity pays a civil penalty of at least $1,000 and not to exceed $5,000 for each day that the policy has remained in effect after it has been found to be violating these provisions. 

·          States that the court will collect the penalty and transmit the collected monies to the Department of Public Safety for deposit in the Gang and Immigration Intelligence Team Enforcement Mission (GIITEM) Fund.

·          Indemnifies officers against actions brought under these provisions, except if the officer has been adjudged to have acted in bad faith.

·          Stipulates that these provisions are to be implemented consistent with federal immigration law protecting the civil right of all persons and respecting the privileges and immunities of US citizens.

-------New Vera Report Shows Difference between Geriatric Release Policy and Practice-------

Harsh sentencing policies have made correctional facilities throughout the United States home to a growing number of older adults. Yet most states with provisions for releasing older prisoners rarely use them, despite the relatively low risk eligible inmates would pose to public safety and the opportunity for potential cost savings.

“It’s About Time: Aging Prisoners, Increasing Costs, and Geriatric Release” examines statutes related to geriatric release in 15 states and the District of Columbia, identifies factors that help explain the discrepancy, and offers recommendations for those who would address it.

“The upshot is that there’s a difference between what states would like to do—save money by releasing older prisoners—and what actually happens,” says the report’s author, Tina Chiu. “If states want the result of geriatric release policies to be consistent with that objective, they should review the release process to address potential and existing obstacles.”

The Vera Institute of Justice is an independent nonprofit organization that combines expertise in research, demonstration projects, and technical assistance to help leaders in government and civil society improve the systems people rely on for justice and safety.

------------------------------ Health Care Reform and Prisoners------------------------

Thirteen million people are incarcerated in jails annually.

Three and a half million of this 13 million are incarcerated more than once during the year.

 The Patient Protection and Affordable Care Act and the Health Care and Education Affordability Reconciliation Act (together referred to as "the health reform law" expands health insurance coverage by expanding Medicaid, the federal-state health insurance program for low income people, to cover everyone under 133 percent of the federal poverty level (FPL). For uninsured individuals above 133 FPL the bill sets up state-based "health insurance exchanges" or regulated insurance marketplaces where individuals and small businesses can compare and purchase private health insurance policies. (They will function something like websites like Travelocity or Orbitz, but for health insurance.) Lower income individuals will be eligible for tax subsidies to buy insurance on the exchanges.

The health reform law does not change the current inmate exclusion for Medicaid and other federal health programs. Convicted inmates are also ineligible for insurance from the exchanges. However, pre-conviction inmates remain eligible and they also remain subject to the individual mandate to carry health insurance.

Regardless of the insurance arrangements covering prisoners, jails will still have a legal obligation based on the /Gamble /decision by the Supreme Court to provide medical care for all prisoners regardless of conviction status. How this obligation will be satisfied or impacted by the health reform legislation has not been addressed.

 There are two additional references to the criminal justice system in the health care bill. First, "conviction for a relevant crime of patient or resident abuse" disqualifies a person from being hired
as a health care worker, and second, the Federal Bureau of Prisons is specifically included in the Interagency Working Group on Health Care quality.

The Legal Action Center reports that the final health care bill incorporates many key elements on addiction and mental health services, as follows:

Includes substance use disorder and mental health (SUD/MH) services as required benefits in the basic benefit package for individual and small business health plans;

Requires that all plans in the health insurance exchange comply with the Wellstone/Domenici Parity Act in providing SUD/MH benefits in the same way as all other covered medical and surgical benefits;

Expands Medicaid eligibility for all Americans up to 133 percent of the federal poverty level and require newly eligible parents and childless adults receive coverage that includes SUD/MH services provided at parity;

Includes SUD and MH prevention strategies and efforts in the bill's chronic disease initiatives;

Includes the capacity of the mental and behavioral health workforce as high-priority topics in the bill's National Workforce Strategy section; and

Includes insurance reforms and consumer protections critical for individuals seeking or in recovery, including prohibiting insurers from denying coverage to people with pre-existing conditions, charging higher premiums based on health status, and placing annual or lifetime caps on insurance coverage.

CALL TO ACTION - FORWARD WIDELY

Women at South Bay are being served bug-infested food, are forced to live  in flooded cells, and daily face unsanitary and dangerous conditions.  Women are refusing meals and demanding that the situation immediately be  put to rights.

Grievances have been filed about food infested with maggots*; rat  droppings have also been found in prisoners' food.  The late rain may have been an annoyance to some of us, but it was flooding the women's cells in the tower where they are held.  One woman was given a plastic trash bag to deal with the leaks, which bag was soon filled with water.  Another woman took to using her personal property, blankets, towels, sheets, and clothing to stuff up the leaks, all of which was soaked almost
immediately.  Even the ceiling of the visiting room was severely damaged by recent rain.

The facility is fewer than 20 years old.  In response to the complaints, the institutional grievance coordinator declared the food and flooding situations “resolved,” despite the fact that the leaks have not been fixed and the food sanitation situation is merely being “investigated.”

Hidden in plain sight, this Boston facility is right off Mass Ave by Boston Medical Center.  The repulsive conditions at South Bay are bad enough in their own right, but consider that the captive population is much more likely to have compromised immune systems, whether because of
hepatitis C, diabetes, HIV/AIDS, or an array of other conditions.  For people suffering from chronic medical issues, South Bay's filth is nothing short of a threat on their lives.

Call Sheriff Andrea J.Cabral this week at 617.635.1000, ext. 2100 and tell her that she is responsible for the health and wellbeing of those in her custody.  An effective public relations machine is not enough.  Demand that meaningful changes are made immediately with input from those women
most suffering from the issues at hand.  The two most important issues to the women inside right now are 1. the food and 2. the leaky cells.  We encourage people to leave call back numbers and demand a response from the administration.  We also encourage you to write bostonabc@riseup.net and tell how your call went!

Description:

Thalia Outlaw is serving life in prison for something she did NOT do. She was convicted in 1999 of murder. In fact, it was self defense in a domestic situation with a man whom she was no longer involved with and who continued to harass and stalk her. The vandalism of her property and physical assaults on her person had become overwhelming for her. Three months pregnant with her youngest child and only daughter, Thalia had moved on and was involved with another man. This did not stop her obsessed ex-boyfriend from continuing to stalk her. On the morning of July 6, 1997, Thalia woke to find her car vandalized and the extra set of keys to her car and home missing AND a flat tire on her vehicle. Knowing who had done this (because he had called and harassed her telling her what he was going to do), she asked a friend to ride with her to retrieve her extra keys from the ex. Thalia did make a mistake that day; she did NOT call the police. But the police had failed her on the prior occasions and having had a similar incident occur approximately a week prior she felt she would be safe and be able to get her keys back without incident. That was not the case. Upon arriving at a mutual friends home, Thalia approached her ex-boyfriend and asked for her keys back. An immediate physical attack on her person began by her ex using a knife. To this day, she carries the scars of those cuts. At some point during the struggle over the knife, the ex received a wound to the upper clavicle area. This did not stop him; he continued to assault her with his fists hitting her in the stomach area raging that he would kill her and her unborn child. The "mutual friend" that was there interceded and the ex-boyfriend left the home and drove to the hospital. Thalia left the home and drove by the hospital in an attempt to have her injuries looked at but seeing the car there of her attacker, she proceeded to the police station to file another assault charge. Thalia never left the police station that day. As she was finishing her report, the call came that the ex boyfriend had died; Thalia was charged with murder and spent 3 days in jail. An individual in the jail recommended an attorney to her; she called and he came to "help". Thalia was told by several investigators and police officers that they knew this was self defense and that she didn't need to worry. Trusting the system to work, Thalia plead NOT GUILTY. After all, how could she be guilty when the alleged weapon was never in her possession? A year and a half later Thalia went to trial. In a day and a half and less than 2 hours of deliberation, Thalia was convicted of murder and sentenced to life. Not one of the prior assault charges were presented to the Court to establish the history of domestic abuse. The missing "weapon" was not available to prove that she never had it in her possession. Further, the many discrepancies in testimony were not pursued by her counsel. In fact, he was chastised during the trial for whistling during court. Having no family in Mississippi to offer support, Thalia has hung on in a Mississippi prison with no help from anyone. Filing her PCR's and appeals, with no information from her case and no copies of the police reports, Thalia has found herself time barred to pursue her innocence. (read less)

World Health Day at The Palestinian Wall...

LIFE IN PALESTINE.

My apologies to all for running out so abruptly on that last post, suggesting that crashing a MEChA meeting or supporting an action for Palestinians here and there constitutes "cross-movement organizing."

 
It does not.

 
By my account, cross-movement organizing is deliberate engagement of both leadership and the people of other movements - or other branches of the global movement for universal liberation (which encompasses aspects of environmental and animal rights activists' agendas as well) - as strategic allies in campaigns, actions, messaging, etc. It's a process of recognizing and redefining common ground (and common opposition), working out areas of conflict between us, and building solidarity that extends beyond specific issues or actions to a general sharing of human, technological, and economic resources.


For example, "Jobs With Justice" has a campaign that encourages us to pledge that "I'll be there" at least 5 times in the next year for someone else's action - to fight for their health care, housing, or liberation, knowing theirs is intricately tied to mine. I don't know how it's working in action, but it's a great concept.




 
My ASU comrade Emmanuel Gallardo, did an awesome job of cross-movement organizing with the "ASU Social Justice Coalition" a few years ago, which had members from many different student groups involved.


Boy, did we give President Crow some grief.


It's the most diverse and active student organization I've been a part of, and while it was extremely ambitious and demanding, it was also quite inspiring. I learned a lot from Eman's approach - he already had connections with every Latino organization on campus, but bent over backwards to connect with everyone else - from the NAACP and nAfrican American Men at ASU, to the Greens, to the LGBTQ community - and get us all to share our energy and resources - including bodies at rallies and actions.



So, what I 've been doing is using the expression "cross-movement organizing" loosely to describe my clumsy efforts to establish relationships with people outside my immediate safety zone right now for the purpose of building explicit support for prison abolition. My recent connections include PUENTE, CODE Pink, the Brown Berets de Aztlan, the Liver Foundation, some Anarchafeminists, MEChA and these folks, the Students for Justice in Palestine.



I think it's all connected anyway, of course - capitalism, war, racism, colonialism, prisons. Compulsory labor and the use of our bodies as soldiers, slaves, consumers or merchandise via coercion, co-optation, and criminalization (or the threat of it) still continues to this day. But the organizing around those principles, the personal connections, all that needs to be deliberate, consistent, prolonged, authentic.

 
I'm deliberate and authentic, but I'm also sporadic on the bigger scale, and may crash and burn tomorrow. I live on my own schedule, and am distracted by several different drummers in my head, so to speak. I'm something of a shy person, actually, unless I'm really all fired up about something or writing. I'm not too socially ept in many ways, so this isn't all just coming naturally to me. I think I'm a little frayed from too many years of drugs and a few too many volts through my brain. Or maybe I'm just still rough around the edges, as they say.

 
In any event, cross-movement organizing is what I'm working on, but not with grace or ease. Take your lessons on that from the Black Panthers, et al - and keep in mind that the only thing that changed really about COINTELPRO is the language and the law: it's still happening. This cross-movement stuff really threatens them. That's why the Anti-Arpaio rally in January got disrupted by the cops...

Need not generate more bad vibes there, today, though. This post is really about the Wall. I was so stunned when it came into view on Hayden Lawn Wednesday (World Health Day) that I just put all my stuff down and took it in. I started photographing when I moved in closer, then came upon these words of a child....

I began to weep, right there, in the middle of the lawn with my tripod and camera in hand, in the shadow of this tower of heartrending scrawl, the narrative of perpetual occupation and war punctuated by photographs of dead and dying kids.

One cannot walk away from that wall and not be changed by the sudden visage of the blood we have on our hands. That has left me somewhat speechless; the magnitude of the prison industrial complex and how intricately tied it is to the perpetuation of war and violence. Tune into NPR for a piece on the supplies finally reaching the Gaza Strip today for the first time in years - the world's largest open-air prison. Good for the Black Market - of course there is violence and inequality there, too, but at least it's a manifestation of the Resistance. Those people have done what they've needed to in order to survive another generation of genocidal policies. The economy is still so decimated, though. 


What does Israel hope to achieve by continuing to terrorize and massacre their neighbors?

What do we hope to accomplish that way, for that matter?

Solitary Watch Watches National Geographic's Experiment in Solitary Confinement

As we wrote earlier, it’s hard to say whether the National Geographic Channel’s treatment of solitary confinement will do more harm than good. In addition to an upcoming episode of “Explorer” on the subject, the NG Channel is hosting an ”experiment” that promises to provide a “live window into the solitary experience,” in which three subjects spend a week in faux lockdown cells (unless they want to leave earlier), with cameras streaming live video to the public and the “prisoners” providing updates on Twitter.

The potential good comes from the evidence of psychological damage that will probably surface even in the fresh-faced young volunteers who spend a mere week in the pristine “cells.” (And to its credit, the NG Channel’s site makes an effort to put their experience in broader context.)

The potential harm comes from the audience thinking what they watch on the live video stream bears any resemblance to the actual experience of prisoners in solitary confinement–which is far worse, in ways too numerous to count. After observing the NG experiment for a week, viewers could easily conclude that solitary confinement is extremely unpleasant, but falls short of constituting cruel and unusual punishment–and is far from the torture some critics say it is.  If so, they would be basing their conclusions on faulty evidence.

First of all, hardly anyone spends just a week in solitary. Used for “disciplinary” purposes, spells in solitary can last anywhere from several weeks to several years. Many of the inmates who end up in solitary are mentally ill; others (including many children) are there for their own “protection,” but nonetheless endure the same cruel conditions.

In addition, some 25,000 American prisoners live in long-term or permanent lockdown, which often stretches to decades: Herman Wallace and Albert Woodfox, of the Angola 3, have spent most of the past 37 years in solitary; Tommy Silverstein has spent an uninterrupted 27 years in solitary under a “no human contact” order; Syed Fahad Hashmi, who is accused of offering material support (in the form of clothing) to terrorists, has spent nearly three years in ultra-isolation under “Special Administrative Measures,” though he has yet to be convicted of a crime...

ON DIRECT ACTIONS, CIVIL DISOBEDIENCE, ETC.

The timing for this seems appropriate, though I think I originally wrote it for the Friends of Marcia Powell and stuck it in a widget soon after the anarchists were accosted by the PPD...anyway, it's in quotes, but it's me, just at a different point in time than today...

If anything should happen to me, by the way, just keep up the “Free Marcia Powell” campaign. I can take care of myself - Marcia will cover everyone. We still need to have that memorial in May.

Anyway, before moving on, since I have everyone's attention: I understand that the former Deputy Warden from Lumley Yard at Perryville prison was the kind of person who often took the time to ask the women what they thought, how they were doing, what they needed – and responded. Bailey, I believe. She's retired now; she was one of the ones who cared, according to a few prisoners I've heard from in recent months.

I don't know what went down with all the ADC folks after Marcia died - I can only imagine what a weight some people still carry. It is not my intention to exploit that tragedy to trouble those who are already haunted. In fact, it is Marcia's Friends, not her ghost, that have been summoned to help us here. Anyone can still be her friend and help us change the world.

Anyone.

I don't know that Marcia will "rest in peace," regardless of whether or not anyone else makes theirs. I do believe she would be forgiving, that she would lend us her name and memory generously if we hadn't just taken it (though I did ask...), that her spirit dances at every direct action we plan and follow through on, and that from wherever she is she smiles at every sidewalk - from Phoenix to Amsterdam - bathed in the pastels of children's giant chalk and urging Arizona to Free Marcia Powell...

she's gotta love that photo we found of her in Phoenix, too. That was thanks to the Alaskan blogger at Frozen Justice. Kick ass up there, my friend. Blogging women rock!

Anyway, I don't think it was "God's mysterious ways" that led to Marcia's death even if we make good come from it somehow - they were all our ways, collectively, as a community, in the years leading up to her final hours in a cage. We neglect and abuse our sisters on the street and inside still daily.

But, I also know it's possible to exaggerate the personal sense of responsibility one may have when something like that ultimately happens. So, it seems worth mentioning that I also believe that Love's capacity for understanding and reconciliation is beyond our own imagining, and that She is fully capable of responding to anyone burdened by Marcia's death - or a similar such trauma - who asks for help.

I survived the suicide of a loved one nine years ago Easter Sunday. I know something of which I speak.

Welcome to the April 2010 edition of Spirit of Freedom.  As we go to print we are
awaiting the sentencing of American eco- activist Steve Murphy who has admitted
conspiracy to commit arson following an attempted arson on a town house which was
claimed by the ELF.  Steve is expected to be sentenced very soon and we will send
out the details of his sentence as soon as we have them.

Other major news is that British Animal Rights activist, Mel Broughton was recently
released from prison on Bail!  In December 2007 Mel was remanded accused of activity
related to Oxford University (Mel is a well known campaigner against animal abuse
carried out by the University).  In Feb 2009 he was sentenced to 10 years
imprisonment because of his campaigning.  However last month the Court of Appeal
quashed his charges and he was released on Bail.  However he is now expected to face
a new trial in June 2010.  ELP will follow this trial and bring you news as we get
it.

The news of Mel’s release is brilliant.  But please do not forget the other
prisoners who remain locked up away from their friends and loved ones. All of the
prisoners listed below welcome letters of support. So please, regardless of what
languages you speak and regardless of where you live in the world, please support
the eco-prisoners and no compromise in defence of Mother Earth!

to Genetically Modified crop testing. Marie also admitted destroying logging

imprisonment after admitting damaging a communication tower used by the Department
of Defence, cutting the cables on a crane used in creating urban sprawl, and

USA. Serving four to ten years for anti-sprawl arsons, criminal damage to a utility

MOVE is an eco-revolutionary group who carried out protests in defence of all life.

MEChA de ASU Solidarity With Mississippi Youth

Here's some cross-movement organizing for you. A few of us got together yesterday and came up with this sign, then I stopped by the MEChA de ASU meeting and told them what was up, so a bunch of them signed to support the youth and church groups, mainly, working to free the Scott Sisters.

We know this is all about civil rights and justice, not just about seeking mercy.

I'll be down at the Palestinian Wall memorial on Hayden Lawn today seeking support, too.

Hang in there, Mrs. Rasco. All of you. We've still got a long haul ahead, I think, but there's a lot of love and outrage stirring on the Scott Sisters behalf. This is America, after all. This kind of thing should be fixed when it happens here, not re-written for history books...who are we, if we can't be real?

Free Lynne Stewart!

The Friends of Marcia Powell heard from Lynne Stewart today, in response to a postcard we sent her from the First Amendment / Anti-Arpaio Rally at the Cronkite School of Broadcasting a month or so ago.

As an attorney Lynne represented many political prisoners from our great liberation movements pro bono, in many cases, over the past few decades. That's the real reason why the federal government wants to kill her, regardless of what party is in power. You can also do some artwork similar to the campaign for Mumia ( or steal mine and make postcards out of it - I just messed with the color from and ordinary chalked sidewalk). We'll hit the White House, Justice Department, US Congress members, the Washington Post, and everyone else we can think of with "Free Lynne Stewart". She's the one of all the political prisoners who they themselves are probably rooting for the most right now - like Mumia, her life is in danger.
